MyEAPConnect Chart Terms and Conditions of Use
[ORGANIZATION NAME] is pleased to offer you access to a web-based service called "MyEAPConnect." Please read the terms and conditions of use (“Terms and Conditions”) entirely and carefully before using "MyEAPConnect." [ORGANIZATION NAME] may revise these Terms and Conditions without prior written or electronic notice at any time.
These Terms and Conditions generally outline our MyEAPConnect practices and apply to all individuals who access and use MyEAPConnect. By accessing and using MyEAPConnect, you agree to comply with and be bound by these Terms. Your use of MyEAPConnect is voluntary. If you do not agree with these Terms, please do not use MyEAPConnect.
MyEAPConnect is provided by Harting EAP (the “Provider”), a third-party provider. The Provider operates independently of [ORGANIZATION NAME]. Your use of MyEAPConnect is also subject to any Provider terms of use.
The owner of MyEAPConnect is based in the state of Illinois in the United States, and MyEAPConnect is for use only by persons located in the United States. We make no claims that MyEAPConnect or any of its content is accessible or appropriate outside of the United States. Access may not be legal by certain persons or in certain countries. If you access MyEAPConnect from outside of the United States, you do so on your own initiative and are responsible for compliance with local laws.
MyEAPConnect is designed to provide employment assistance resources and provides you with convenient access to select portions of your medical information. To use MyEAPConnect, you must have been granted access by [ORGANIZATION NAME]. The information available through MyEAPConnect may come from many sources including, but not necessarily limited to, information entered into your Employee Assistance Program’s (EAP) chart, results of screening tools, appointments, and/or any other information or data permissibly received from your EAP and their affiliates if used.
Use of Services
You agree to use MyEAPConnect responsibly and in accordance with any guidelines provided by [ORGANIZATION NAME] or the Provider. Misuse of MyEAPConnect, including but not limited to inappropriate behavior, harassment, or violation of the MyEAPConnect terms, may result in suspension of your access to MyEAPConnect.
You may use MyEAPConnect for lawful purposes and in accordance with these Terms and Conditions. You agree not to use MyEAPConnect:
- In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).
- For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
- To send, knowingly receive, upload, download, use, or re-use any material that does not comply with the standards set out in these Terms of Use.
- To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
- To impersonate or attempt to impersonate another user or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing).
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment MyEAPConnect, or which, as determined by us, may harm MyEAPConnect or its users, or expose them to liability.
Additionally, you agree not to:
- Use MyEAPConnect in any manner that could disable, overburden, damage, or impair MyEAPConnect or interfere with any other party's use of MyEAPConnect, including their ability to engage in real time activities.
- Use any robot, spider, or other automatic device, process, or means to access MyEAPConnect for any purpose, including monitoring or copying any of the material on MyEAPConnect.
- Use any manual process to monitor or copy any of the material on MyEAPConnect, or for any other purpose not expressly authorized in these Terms, without our prior written consent.
- Use any device, software, or routine that interferes with the proper working of MyEAPConnect.
- Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of MyEAPConnect, the server on which it is stored, or any server, computer, or database connected to MyEAPConnect.
- Attack MyEAPConnect via a denial-of-service attack or a distributed denial-of-service attack.
- Otherwise attempt to interfere with the proper working of MyEAPConnect.
Reliance on Information
The information presented on or through MyEAPConnect is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Website, or by anyone who may be informed of any of its contents.
MyEAPConnect contains content provided by third parties. All statements and/or opinions expressed in these materials, and all articles and responses to questions and other content, are solely the opinions and the responsibility of the person or entity providing those materials.
Communication/Electronic Messaging
You can use electronic messaging on MyEAPConnect for secure communication. The electronic messaging function allows you to send non-emergent questions to your EAP Staff. In most cases, your EAP Staff who respond to electronic messages may not be immediately available. Therefore, you should generally expect a response to take two (2) or more business days. You should still discuss questions directly with your EAP by phone if you have questions.
If you are experiencing an emergency or need immediate attention, do not use MyEAPConnect . Call 911 or go to the emergency room for any emergencies. Also, if you have a non-emergency issue that requires more prompt attention, please call your EAP directly.
Furthermore, with respect to any electronic message, your EAP staff may only be able to respond based on the information provided. If there is incomplete or inaccurate information provided, they may be unable to provide accurate and reliable responses.
Although you may have access to a variety of records (i.e., sessions, messages, appointments) through MyEAPConnect, not all of your EAP Staff may utilize electronic communications through MyEAPConnect. Therefore, you might not be able to communicate through MyEAPConnect with all of your EAP staff particularly if you were seen by an Affiliate of the EAP. You should contact any Affiliate of the EAP in the manner you currently do. You can always ask your EAP Staff about whom to contact with questions or concerns about any item on your MyEAPConnect Chart.
Please know that if you send an email communication via MyEAPConnect to your EAP, it may be shared with or used by third parties that assist them in rendering or coordinating your care. A patient's information available through MyEAPConnect will be accessible to staff members designated by your EAP. The ways in which such information may be accessed, used, or disclosed should be set forth in such provider's HIPAA Notice of Privacy Practices. Communication Preferences
You can adjust your communication preferences in MyEAPConnect based on how you would like to receive email, text, call, and mail notifications (“Notifications”) from [ORGANIZATION NAME] (“Communication Preferences”). Your Communication Preferences selected in MyEAPConnect will apply to all Notifications but are not limited to communications regarding your upcoming or missed appointments. Notifications may use an autodialer and/or pre-recorded or artificial voice and may be repeated multiple times per appointment and may exceed contacts more than three times per week.
If you elect to communicate from a workplace computer, email account, or workplace phone, please be aware that your employer and workplace agents might have access to those email and text communications. It is also important that you maintain accurate and up-to-date contact information and update MyEAPConnect with any changes.
Text Message Notification/Short messaging Services ("SMS Service(s)")
SMS Services allow you to receive automated text messages about visit updates. You can opt-in to receive SMS Services by providing consent, adjusting your Communication Preferences in MyEAPConnect.
You can cancel the SMS service at any time. You can control your text notifications from your communication preferences in MyEAPConnect if you have an account. You can text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.
If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
Neither the cell phone carriers nor the Provider are not liable for delayed or undelivered messages.
As always, message and data rates may apply for any messages sent to you from us and to us from you. The number of messages you receive will depend on the number of notifications you select and your engagement. Proxy Access
Storage
By using MyEAPConnect for electronic communications, you hereby acknowledge and agree that [ORGANIZATION NAME] is in no way responsible or liable to store, manage or transmit any electronic communications beyond a thirty (30) day period. It is your responsibility to retain any such electronic communication that you wish to retain. You hereby release [ORGANIZATION NAME] from any and all claims related to the storage, availability or destruction of any message or electronic communication (including audit trail data) beyond this thirty (30) day period. Finally, you acknowledge and agree that [ORGANIZATION NAME] may use any reasonable method of deletion or destruction of such message or electronic communication that it deems proper.
While we try to keep the information on the site as accurate as possible, we cannot guarantee its accuracy, timeliness or completeness; nor can we guarantee that access to the site will be error- or virus-free or uninterrupted. In addition, for some information and records, an automatic delay may be built into the system to allow your EAP Staff to do things such as review your sessions, contact you to discuss your results, or other professional activities that the EAP staff deem clinically appropriate.

These website links are solely intended for information and reference purposes only and should not be used as a substitute for the advice of your EAP Staff. [ORGANIZATION NAME] does not endorse and have not verified the accuracy of the information in/on these websites. You should not rely solely on any of the information found on such websites for purposes of treatment or diagnosis. Please be aware that the privacy policies of these websites may significantly differ from the privacy policies of [ORGANIZATION NAME]. [ORGANIZATION NAME] is not responsible for the privacy practices of such other websites. We encourage you to be aware when you leave MyEAPConnect and to read all third-party policies before using their website.
Information Availability
Due to certain federal and state laws regarding minors and/or due to the technical limitations of MyEAPConnect, not all sections of your chart may be made available via this service.
If you think something is missing or inaccurate, you should contact your EAP Staff directly.
Minor Eligibility
MyEAPConnect is offered and available to users who are [13/18] years of age or older. By using MyEAPConnect, you represent that you meet this eligibility requirement. [A minor’s parent or guardian will have access to limited registration and scheduling information; however, a minor's parent or guardian will only have access to minor’s full MyEAPConnect account in the following, limited circumstances: (1) when the EAP Professional reasonably believes that the minor lacks capacity to consent/participate in the MyEAPConnect process; and/or (2) when the health care needs of the minor are so complex that the minor's EAP staff believes it is appropriate for both the parent and the minor to have full access to the minor's MyEAPConnect account. However, under State and Federal law, there are certain types of health information that the parent or guardian of a minor may not view without the consent of the minor, and therefore, the minor and the minor's EAP Staff member must give their written consent before the parent or guardian will have access to such information. This applies to registration and scheduling information where adolescents may consent for their own care.]
Email Privacy
MyEAPConnect will generally notify you via email in accordance with your Communication Preferences when there is new or modified information to be viewed on MyEAPConnect. This means that any person with access to a patient's email account will be able to see this notification. This could include the client's spouse, child(ren), employer or anyone else who can access the client's email account. Although no specific information will be sent in the notification, the notification of new information being available by accessing MyEAPConnect may be information that a client would not want others to know. Thus, patients should take this into account when providing or changing the email address on file with MyEAPConnect.
Security and Confidentiality
We have taken steps to secure information against unauthorized access, use, and release.
In general, you must access MyEAPConnect with a Secure Socket Layer (SSL) compatible browser or terminal (Internet Explorer version 7.0 or later or Chrome version). These requirements may change over time. We utilize physical, electronic, and procedural safeguards to promote the prevention and detection of unauthorized access, maintain data accuracy, and help ensure authorized use and disclosure of information. We take measures to allow access to the information only to those employees, clinical providers, contractors, and service and equipment providers who need such access in connection with providing services to you, to us or on our behalf. If you become aware of any actual or suspected unauthorized use or disclosure of your information via these services, you should immediately contact us.
You can generally tell when you are using a secure site by looking at the location (URL) field. If the URL begins with https:// (instead of http://), the document/link should come from a secure server. This means your data will be difficult to read or decipher by unauthorized individuals when being transmitted across the internet. Further verification can be done by viewing the site's SSL certificate (the process for this varies depending on which browser you are using) and verifying that the certificate is verified by a trusted root certificate authority.
Your MyEAPConnect account information and profile are password protected. Usernames and passwords provide two layers of security and authentication. As a MyEAPConnect user, your role in maintaining the security of your medical information is critically important. You should always:
- Use a strong password. A strong password is typically considered one that has the following attributes:
- it has a lengthy (8 characters or more) combination of upper/lower case letters, numbers, and special characters;
- and it does not contain and is not derived from words, names, or other common or easily guessed combinations (i.e., birth date).
- Change your password on a regular basis (every 90 days is a widely accepted security recommendation).
- Keep your login ID and password strictly confidential. You should not share your password with anyone.
We will never ask you for your password in an unsolicited phone call or in an unsolicited email. You should sign out of your account and close your browser window when you have finished your session, so others cannot access your personal information. This is especially important if you share a computer with someone else or use a computer in a public place. You should be cautious in using the "Remember My Password" or "Remember Me" function on your computer or web browser. These functions may compromise the secure or confidential nature of your information, especially if you are using a computer shared by more than one person. If you become aware of any actual or suspected unauthorized use or disclosure of your information or your username or password, you should immediately contact us.
Although we use security safeguards in providing access to these services, other data transmission methods over the internet or via a wireless network may not be as secure. You should always be cautious in your use of unsecured, unknown, or suspicious networks, wireless access points, and/or websites, especially if such use includes the transmission of personal, confidential, or private information (such as health or medical information, financial information, etc). Additionally, if you print out any information from MyEAPConnect then that information may not be private information anymore.
Suspension/Deactivation
Your ability to access or use MyEAPConnect may be suspended or deactivated at any time, at the discretion of [ORGANIZATION NAME] or Provider. The following is a non-comprehensive list of reasons which may result in suspension/deactivation. The list is not exhaustive or complete.
- Automatic system deactivation will occur after a number of failed login attempts to access the secure portion of the MyEAPConnect system.
- Inappropriate use of messaging or scheduling (ex: excessive, unnecessary, inappropriate content).
- Violation of security standards or any provision of these Terms and Conditions.
- Inability to use features without repetitive or continued assistance.
- To protect you or your information from suspicious activity or other known or suspected security concerns.
- To protect others or others' information from suspicious activity or other known or suspected security concerns.
- To protect the MyEAPConnect systems, or their information from suspicious activity or other known or suspected security concerns.
How we may additionally use information generated through your use of MyEAPConnect
[ORGANIZATION NAME] may track users' requests, inquiries, and traffic patterns as part of our own internal monitoring of patterns of usage, audience size, repeat usage, and internal audits.
While you are logged into MyEAPConnect, we may log your IP address (a number assigned to your computer when you use the internet), your browser type and platform, access times, and other access and use data to track and audit usage patterns, security parameters, and other key metrics.
[ORGANIZATION NAME] does not have access to details of your interactions with MyEAPConnect, including the nature of your consultations, except in circumstances where you have given explicit consent or as required by law.

We perform these activities to maintain the functionality and security of the site, to notify you whenever your account is accessed, and to develop/provide more, different, or better services, options, and uses in the future.
Cookies and Tracking Technologies
In order to facilitate MyEAPConnect navigation, improve functionality, and personalize and enhance your experience on MyEAPConnect, [ORGANIZATION NAME] or Provider may also collect information through a security cookie as well as by tracking certain technical information about your computer. Cookies are small strings of text that are sent by MyEAPConnect to your browser and then stored by your browser on your computer's hard drive. However, rejecting cookies may prevent you from taking advantage of certain portions of MyEAPConnect.
While the Provider may utilize tracking technologies monitor your use of MyEAPConnect for purposes of administering the services, [ORGANIZATION NAME] does not track or monitor your use of the services.

All images, text, and other materials posted on MyEAPConnect (other than your personal medical information) are subject to copyrights owned by [ORGANIZATION NAME] or the Provider, and/or other individuals or entities and are protected by United States copyright laws. Any reproduction, retransmission, distribution, or republication of all or part of any images, text programs, and other materials found on this site (other than your personal EAP information) is expressly prohibited, unless the copyright owner of the material has expressly granted its prior written consent. You hereby consent and submit to the exclusive jurisdiction of the state and federal courts located in St. Clair County, the state of Illinois, in all questions and controversies arising out of your use of MyEAPConnect.
Severability and Waiver
If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions contained herein, which shall remain in full force and effect. No waiver of any provision of these Terms and Conditions shall be deemed a continuing waiver of such term or condition or any other term or condition.
Changes to MyEAPConnect
The content on MyEAPConnect may be updated from time to time, but its content is not necessarily complete or up to date. Any material on MyEAPConnect may be out of date at any given time, and we are under no obligation to update such material.
